The evidence of intent is all over the indictment. He just needed to know that he had classified material, and retain it after he was told to give it back.

He did that and more. He told his lawyers to lie to investigators and destroy documents. That destroys attorney client privilege, which is why some of the most damning evidence comes from one of his own former lawyers.
